1. Privacy Policy

1.1 General dispositions

The Single National Emergency Call System, hereinafter referred to as SNECS, is founded and administered by the SNECS administrator, in accordance with the provisions of the Government Emergency Ordinance no. 34/2008 on the organization and operation of the Single National Emergency Call System, with subsequent amendments and completions, in order to provide the Citizens with the 112 Emergency Service.

The 112 Emergency Service ensures the reception of emergency calls from citizens and, as the case may be, their transfer to the specialized intervention agencies, or their processing and direct alerting of the first responders in order to obtain an immediate, uniform and unitary response to handle emergencies.

The "Apel 112" emergency Application works only on the mobile devices using a public communications network, which is in the area of responsibility of an authorized mobile operator, according to the Government Emergency Ordinance no. 111/2011 on electronic communications, with subsequent amendments and completions, on the Romanian territory.

All personal data processing activities carried out within or in connection with the "Apel 112" emergency Application are in line with the provisions of the Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and of the Law no. 190/2018 on implementing measures to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

1.2 Terms and definitions

Personal data – any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Processing – any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

Consent – freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;

Controller (Operator) – Special Telecommunications Service, which processes personal data, as SNECS administrator, according to the provisions of GEO no. 34/2008, with subsequent amendments and completions, as well as pursuant to the content of these terms and conditions.

Associated operators – the specialized intervention agencies, as defined and regulated in GEO no. 34/2008, with subsequent amendments and completions.

Data subject (User) – the natural person, Romanian or foreign citizen, who expresses his/her consent in order to use the "Apel 112" emergency Application in compliance with these terms and conditions.

Supervisory authority – The National Supervisory Authority for Personal Data Processing (ANSPDCP).

1.3 Principles

The controller's privacy policy is based on the following principles:

1.4 Which data are processed?

The personal data collected from the data subject's device or filled in by the user are processed via the "Apel 112" emergency Application, as follows: telephone number (s) and location coordinates.

The personal data is securely transmitted to the controller only when pressing the "Call 112" or "Send Location" button, via the API (Application Programming Interface) available at https://location.112.ro, and after their registration in SNECS, they may be available, as the case may be, to the associated operators, in order to handle the emergency call and solve the case reported by the caller.

The telephone number, as well as the location information transmitted to the 112 Emergency Service represent personal data and are processed in accordance with the provisions of Regulation (EU) no. 2016/679 on the protection of personal data, the provisions of Law no. 190/2018 on measures to implement Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation) and other applicable legislation.

The "Apel 112" emergency Application is installed and used after the explicit data subject`s permission, and thus the personal data transmitted to the SNECS via the application are processed under the freely given, specific, informed and unambiguous consent of the application data subject, in accordance with the provisions of the legislation in force and under the conditions of this policy and of the terms and conditions of the "Apel 112" emergency Application use.

After the transmission of the data to the SNECS, they are associated with a case file and stored for a period of 5 years according to the provisions of the art. 19 of GEO no. 34/2008, with subsequent amendments and completions.

The controller, as well as the associated operators, ensures the security and confidentiality of the personal data processed within the SNECS, meaning that:

  1. the location and the telephone number filled in the application will be transmitted to the SNECS Information System, via API (Application Programming Interface) available at: https://localizare.112.ro, only when pressing the "Call 112" or "Send location" button, provided that the data subject`s mobile device has a data connection and its location services are enabled;
  2. the location information will be transmitted to the 112 Emergency Service using the data connection of the device, via https protocol and will contain the pre-entered phone number (s) related to the device, the GPS coordinates and the location accuracy, in a format established by the "Apel 112" Emergency Application Provider;
  3. the location information sent to the 112 Emergency Service will be made available to the entities involved in the emergency service only in direct association with an emergency call;

In case of a failure while using the "Apel 112" emergency Application, in order to automatically identify and correct the error, the data and information on your device are automatically collected through Log Data, such as your device model and manufacturer, the version of the operating system, the Application configuration (version), date and time of the application use and other relevant statistics. No personal information is collected for this error identification and correction process. The information collected is kept secure and protected by the controller, being used only in accordance with the provisions described in this policy.

The installation of the "Apel 112" emergency Application on the data subject's device does not involve the processing of the data subject`s personal data by the controller.

1.5 Modification of the personal data processing policy

This policy on the processing of personal data may be updated as a result of the modifications in the relevant legislation in the field, or of the changes in the structure and the features of the "Apel 112" emergency Application.

In the event of modification of the personal data processing policy, the data subjects will be notified by posting an information message on the application screen. Reading the message and further use of the "Apel 112" emergency Application represent the user's consent to the changes implemented and thereby, to the new version of the policy.

You may exercise your right of access to your personal data processed within the SNECS, by filling in the form https://www.sts.ro/ro/solicitare-info-apel-112, or in writing, at the abovementioned address.

Should you consider that your rights regarding the processing of personal data have been violated and the Special Telecommunications Service has not handled the complaint in a sufficient manner, you may lodge a complaint with the supervisory authority – The National Supervisory Authority for Personal Data Processing, based in Bucharest, Blvd. General Gheorghe Magheru no. 28 - 30, 1st District, postal code 010336.

2. Terms of Use

* The Single National Emergency Call System, hereinafter referred to as SNECS, is founded and administered by the SNECS administrator, in order to provide citizens with the 112 Emergency Service, which ensures the reception of emergency calls from citizens and, where appropriate, their transfer to the specialized intervention agencies, or their processing and direct alerting of the first responders in order to obtain an immediate, uniform and unitary response to handle emergencies.

** The "Apel 112" emergency Application works only on the devices using a public communications network, which is the responsibility of an authorized operator, according to the Government Emergency Ordinance no. 111/2011 on electronic communications, with subsequent amendments and completions, on the Romanian territory.

The "Apel 112" emergency Application user declares that he has read, understood and fully agrees with the following terms and conditions:

  1. the user is responsible for the use of the "Apel 112" emergency Application;
  2. the "Apel 112" emergency Application is provided "AS IT IS", with no guarantee whatsoever;
  3. the "Apel 112" emergency Application Provider does not guarantee an uninterrupted or error-free operation of the "Apel 112" emergency Application.
  4. the "Apel 112" emergency Application provider does not guarantee whether the errors in the application will be corrected;
  5. the "Apel 112" emergency Application is not meant for those situations when the functional errors or inaccuracy of the content, data or information provided by the "Apel 112" emergency Application may lead to the user's death, injury or property damage;
  6. there is no guarantee that one or all features of the "Apel 112" emergency Application will properly work or be operational at any time;
  7. the "Apel 112" emergency application is not intended and does not involve the replacement of the classical way of announcing the emergency to the 112 Emergency Service, by dialling from the phone call interface of the user;
  8. the "Apel 112" emergency application aims to improve, if possible, the accuracy of the user's location, during the emergency call, by using the existing location information of the user's mobile device under the provisions of the Government Emergency Ordinance no. 34/2008 on the organization and functioning of the Single National System for Emergency Calls, with subsequent amendments and completions;
  9. the proper operation of the "Apel 112" Emergency Application depends on granting by the user of all access permissions necessary to use the features of calling, locating and transmitting of data via the "Apel 112" Emergency Application;
  10. the proper operation of the "Apel 112" Emergency Application is conditioned by entering the phone number (s) (for dual SIM mobile devices) corresponding to the mobile device on which the "Apel 112" Emergency Application is used, so that the call to the 112 Emergency Service to be associated with the transmitted location data. Entering the phone number(s) does not involve enrolling the application in the SNECS computer system, the number(s) being stored locally in the settings of the application installed on this device;
  11. the location information and the telephone number filled in the application will be transmitted to the SNECS Information System only when pressing the "Call 112" or "Location transmission" button, provided that the data subject`s mobile device has a data connection and its location services are enabled;
  12. the location information will be transmitted to the 112 Emergency Service using the data connection of the mobile device, via https protocol and contains the pre-entered phone number (s) related to the mobile device, GPS coordinates and location accuracy, in a format established by the "Apel 112" Emergency Application Provider;
  13. location information sent to the 112 Emergency Service represents personal data and is processed in accordance with the provisions of Regulation (EU) no. 679/2016 on the protection of personal data, the provisions of Law no. 190/2018 on measures to implement Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation) and other applicable legislation;
  14. the location information transmitted to the 112 Emergency Service will be made available to the entities involved in the emergency service only in direct association with an emergency call;
  15. the "Apel 112" Emergency Application Provider is not responsible for the accuracy of the location information extracted by the location services implemented in the operating system of the user's mobile device;
  16. the user agrees that the location information sent to the 112 Emergency Service via the "Apel 112" Emergency Application may be inaccurate and understands that their accuracy depends on the capabilities of the mobile device on which the application is installed and the quality of the data and GPS connection;
  17. the costs generated by extracting the location information from the user's mobile device, translated into mobile data traffic, will be fully borne by the user, being covered by the mobile data options included in the subscription or prepaid service, if applicable. (The mobile operator will not impose extra charges to the user for the traffic generated by the "Apel 112" Emergency Application when accessing the location services on the user's mobile device);
  18. the Google and Apple liability for the accuracy of the location information extracted by the location services from the user`s mobile device is limited.
